Terms of Service

These terms are a binding contract between you and Movie Geo. Please read section 13, which requires most disputes to go to individual arbitration rather than to court, and section 11, which limits what we can be made to pay you.

1. Agreement

Movie Geo (the "Service") is operated by Noah Manning, a sole proprietor located in Virginia, United States ("we", "us", "our"). By opening, browsing, or playing Movie Geo at movie-geo.com, or by subscribing to Movie Geo Plus, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service.

2. Who may use Movie Geo

You may use the Service if you are 13 or older. If you are under 18, you may use it only with the involvement of a parent or legal guardian, and only that parent or guardian may purchase a subscription. By subscribing you represent that you are at least 18 and legally able to enter into this contract.

You may not use the Service if you are barred from doing so under the laws of the United States or your country of residence, or if we have previously terminated your access.

3. The service

Movie Geo is a geography trivia game about film. You read a clue and tap a country or a U.S. state on a globe. Some features are free. Movie Geo Plus is a paid subscription that removes the daily question limit.

We may add, change, suspend, or remove any part of the Service at any time. We may change the number of free questions, the content of the question bank, or how scoring works, without notice.

4. Your account

Movie Geo does not use passwords. Access to Plus is tied to a signed token issued after payment and to the email address used at checkout. You are responsible for keeping that access, including any sign-in link sent to your email, private. Anyone with your sign-in link can use your subscription.

Your progress is stored in your browser and, if you subscribe, may also be stored on our servers so it follows you between devices. Clearing your browser data may erase local progress. We are not liable for lost progress, scores, or streaks.

5. Plus, billing and renewal

Movie Geo Plus is offered on a monthly or yearly basis at the prices shown at checkout, currently $2.99 per month or $19.99 per year in U.S. dollars, plus any applicable tax.

Your subscription renews automatically. Unless you cancel before the end of the current billing period, it will renew for another period of the same length, and the payment method on file will be charged the then-current price automatically.

Payments are processed by Stripe, Inc. We never receive or store your full card number. Your use of the payment flow is also subject to Stripe's terms and privacy policy.

We may change prices. If we do, the new price applies to your next renewal after we notify you, and you may cancel before then if you do not accept it.

If a payment fails, we may retry it and may suspend Plus access until payment succeeds.

6. Cancelling and refunds

You may cancel at any time from the billing portal linked in the app, or by emailing us. Cancellation takes effect at the end of the billing period you have already paid for, and you keep Plus access until then.

Except where a refund is required by law, all payments are final and non-refundable, including for partial billing periods and for periods during which you did not use the Service.

Nothing here limits any non-waivable right you have under the consumer protection laws of your state or country. If you believe you were charged in error, email us and we will look at it.

7. Our intellectual property

The Service, and everything in it that we made, is owned by us and protected by copyright, trademark, trade dress, and other laws. That includes, without limitation:

We grant you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and play the Service for your own non-commercial entertainment. That licence ends when these terms end. No other rights are granted, expressly or by implication.

8. What you may not do

You agree that you will not, and will not help or permit anyone else to:

These restrictions are a material part of this agreement. We may investigate suspected breaches and may suspend or terminate access immediately, without refund, where we reasonably believe a breach has occurred.

9. Films, trademarks and third parties

Movie Geo refers to films, studios, festivals, awards, and the people who make them for the purpose of identifying and describing them in trivia questions. That is nominative and descriptive use. All film titles, studio names, award names, and related trademarks belong to their respective owners.

Movie Geo is not affiliated with, endorsed by, sponsored by, or connected to any film studio, distributor, festival, awarding body, or rights holder mentioned in the Service.

The Service relies on third parties including Vercel for hosting and Stripe for payments. We are not responsible for their acts, omissions, availability, or content.

10. Disclaimers

The service is provided "as is" and "as available", with all faults and without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, and non-infringement, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that the service will be uninterrupted, timely, secure, or error free, that defects will be corrected, or that the service or any server that makes it available is free of harmful components.

Movie Geo is a game. We do not warrant that any question, answer, location, coordinate, date, or other fact in the service is accurate, complete, or current, and you must not rely on it for any purpose beyond entertainment.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the service, whether based in contract, tort, negligence, strict liability, or any other theory, and whether or not we were advised of the possibility of such damages.

Our total aggregate liability for all claims relating to the service is limited to the greater of (a) the total amount you actually paid us in the twelve months immediately before the event giving rise to the claim, or (b) fifty U.S. dollars ($50.00).

These limits apply even if a limited remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so some of the above may not apply to you. Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, gross negligence, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.

You and we agree that these limits are a reasonable allocation of risk and are a fundamental basis of the bargain, and that the Service would not be offered at these prices without them.

12. Indemnification

You agree to defend, indemnify, and hold harmless Movie Geo and its owner from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Service, your breach of these terms, or your violation of any law or the rights of a third party.

13. Disputes and arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury hear your case.

13.1 Talk to us first

Before starting an arbitration or any other proceeding, you agree to email us a written description of the dispute and what you want, and to give us sixty (60) days to resolve it informally. Most problems can be sorted out this way and it costs neither of us anything.

13.2 Binding individual arbitration

If we cannot resolve a dispute informally, you and we agree that any dispute, claim, or controversy arising out of or relating to these terms or the service will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and not in court, except as stated in 13.4.

You and we are each waiving the right to a trial by jury.

The arbitration will be conducted in the English language. Unless you and we agree otherwise, it will take place in Virginia Beach, Virginia, or, at your election, by telephone, videoconference, or on documents only. The arbitrator's decision may be entered as a judgment in any court of competent jurisdiction.

13.3 No class actions

You and we agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, coordinated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative proceeding. If this paragraph is held unenforceable as to a particular claim, that claim, and only that claim, will be severed from the arbitration and brought in court.

13.4 Exceptions

Either of us may bring an individual claim in small claims court if it qualifies. Either of us may also seek injunctive or other equitable relief in a court of competent jurisdiction to stop actual or threatened infringement or misuse of intellectual property, including any breach of section 7 or section 8, without first going through 13.1 or 13.2.

13.5 Your right to opt out

You can opt out of 13.2 and 13.3. Email us at noahjasonmanning@gmail.com with the subject line "Arbitration Opt-Out" and your name, within thirty (30) days of first accepting these terms. Opting out will not affect anything else in this agreement, and we will not treat you any differently for doing it.

13.6 Time limit

To the extent permitted by law, any claim relating to the Service must be brought within one (1) year after it arises, or it is permanently barred.

14. Governing law

These terms and any dispute arising out of them are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict of laws rules, and by the Federal Arbitration Act as to section 13. For any matter not subject to arbitration, you and we submit to the exclusive jurisdiction of the state and federal courts located in Virginia Beach, Virginia. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory provisions of the law of your place of residence.

15. Changes and termination

We may update these terms. If a change is material, we will update the effective date at the top and, where reasonably practicable, give notice in the app. Continuing to use the Service after a change means you accept the updated terms. If you do not accept them, stop using the Service and cancel any subscription.

We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have breached these terms or if we discontinue the Service. You may stop using the Service at any time. Sections 6 through 14 and 16 survive termination.

16. General

These terms, together with the Privacy Policy, are the entire agreement between you and us about the Service, and supersede anything said or written before. If any provision is held unenforceable, it will be limited or severed to the minimum extent necessary and the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these terms creates a partnership, agency, or employment relationship. We are not liable for any failure or delay caused by events beyond our reasonable control.
